These Terms of Service ("Terms") constitute a legally binding agreement between Boon and Blessings Private Limited ("Company," "we," "us," or "our") and any individual or entity ("User," "you," or "your") who accesses or uses the OnlinePathPuja.com platform. These Terms are published in accordance with the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020.

1. Acceptance of Terms

By accessing, browsing, registering on, or placing a booking through OnlinePathPuja.com, you unconditionally accept and agree to be bound by these Terms, our Privacy Policy, Refund Policy, and Cancellation Policy, all of which are incorporated herein by reference. If you do not agree to any part of these Terms, you must immediately cease using the platform.

2. Nature of Services and Intermediary Role

OnlinePathPuja.com is an online marketplace and technology platform that facilitates the booking of Hindu religious services. Boon and Blessings Private Limited acts as an intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. While we take all reasonable steps to verify the credentials of pandits and service providers listed on our platform, we do not ourselves perform the religious services and are not liable for the manner in which those services are conducted, except as expressly provided in these Terms.

3. Eligibility

To register and use the services on OnlinePathPuja.com:

• You must be at least 18 years of age. Persons below 18 years may use the platform only under the supervision of and with the express consent of a parent or legal guardian.
• You must be legally competent to enter into a binding contract under the Indian Contract Act, 1872.
• You must provide accurate, complete, and current registration information and keep it updated at all times.
• You must not be barred by any court order or applicable law from receiving services of the kind offered on this platform.

4. User Account

4.1 Registration

You may be required to create an account to access certain features of the platform. You agree to provide truthful information during registration. You shall not impersonate any other person or create an account on behalf of another without their explicit consent.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at contactboonandblessings@gmail.com in the event of any unauthorised access to or use of your account. We shall not be liable for any loss or damage arising from your failure to safeguard your account.

4.3 Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your account at our discretion, with or without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or if we are required to do so under applicable law.

5. Bookings, Pricing and Payment

5.1 Booking Confirmation

All bookings are subject to availability and are confirmed only upon receipt of full payment and issuance of a booking confirmation number via email and/or SMS.

5.2 Pricing and GST

All prices displayed on the platform are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless expressly stated otherwise. We are registered under the GST Act, 2017, and GST invoices will be provided for all transactions upon request.

5.3 Payment Methods

We accept payments via UPI (including BHIM, Google Pay, PhonePe, Paytm), credit cards, debit cards, net banking, and other payment methods as displayed on the platform. All payments are processed through RBI-authorised payment gateways in compliance with the Payment and Settlement Systems Act, 2007.

5.4 Price Changes

Prices are subject to revision without prior notice. However, any price revision will not affect bookings that have already been confirmed and paid for.

5.5 Electronic Contracts

Bookings made on this platform constitute valid and enforceable electronic contracts under the Information Technology Act, 2000, and the Indian Contract Act, 1872.

6. Service Delivery and Standards

6.1 Best Efforts

We shall make all reasonable efforts to ensure that services are delivered as booked, at the agreed time, by a qualified pandit, and in accordance with the ritual specifications provided by the customer. However, we do not guarantee that services will always be delivered without disruption.

6.2 Variations in Ritual Practice

Hindu rituals may vary by region, tradition, sampradaya, and family custom. While we endeavour to match customers with pandits familiar with their specific tradition, we do not guarantee that every ritual variation will be accommodated unless specifically confirmed at the time of booking.

6.3 Force Majeure

We shall not be held liable for failure to deliver services due to circumstances beyond our reasonable control, including acts of God, government orders, curfews, natural disasters, internet or power outages, or any other force majeure event.

7. User Obligations and Prohibited Conduct

You agree to:

• Provide accurate information regarding the nature of the puja, occasion, and any specific requirements at the time of booking.
• Be available and reachable at the scheduled time of service.
• Treat pandits and company staff with respect and dignity.
• Comply with all applicable laws of India in your use of the platform.

You agree NOT to:

• Use the platform for any illegal, fraudulent, or unauthorised purpose.
• Upload, post, or transmit any content that is defamatory, obscene, offensive, or in violation of any law.
• Infringe upon the intellectual property rights of the Company or any third party.
• Attempt to gain unauthorised access to the platform's systems or data.
• Engage in any conduct that disrupts or interferes with the platform's operation.
• Misrepresent your identity, location, or purpose.

Violation of these obligations may result in immediate account termination and, where applicable, legal action.

8. Intellectual Property Rights

All content available on OnlinePathPuja.com, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of Boon and Blessings Private Limited or its content licensors, and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India. No part of this platform may be reproduced, distributed, transmitted, displayed, or used in any commercial manner without the prior written consent of the Company.

9. Privacy

Your use of this platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy is compliant with the Digital Personal Data Protection Act, 2023 and applicable rules thereunder.

10. Disclaimer of Warranties

The platform and its services are provided on an "as is" and "as available" basis without any warranty of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. We disclaim all warranties to the extent permitted under applicable Indian law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, the aggregate liability of Boon and Blessings Private Limited for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you for the specific booking that is the subject of the claim. We shall not be liable for any indirect, special, incidental, consequential, or punitive damages, including loss of profits, data or goodwill.

12. Indemnification

You agree to indemnify, defend, and hold harmless Boon and Blessings Private Limited, its directors, officers, employees, agents, and partners from and against any claim, demand, loss, liability, damage, or expense (including legal fees) arising out of or relating to your violation of these Terms, your use of the platform, or your infringement of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute, claim, or controversy arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the competent courts at Gautam Buddha Nagar (Noida), Uttar Pradesh, India.

15. Amendments

We reserve the right to modify these Terms at any time. Amendments will be posted on this page with the updated effective date. Your continued use of the platform after the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
